These Terms of Service (“Terms”) govern your access to and use of the BornArab website, online store, products and services.

Throughout these Terms, “BornArab”, “we”, “us” and “our” refer to BornArab. “You” and “your” refer to any visitor, customer or user of our website.

By accessing our website, placing an order or using our services, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. About BornArab

BornArab is an independent art brand creating and curating contemporary artwork inspired by Arab culture, identity, heritage, memory and faith.

2. Online Store

Our online store is hosted using Shopify, which provides the ecommerce platform that allows us to offer our products and services to you.

Your use of certain Shopify-powered features may also be subject to Shopify’s applicable terms and policies.

3. Eligibility

By using our website or placing an order, you confirm that you are legally capable of entering into a binding agreement in your jurisdiction or that you have the permission of a parent or legal guardian where required.

You may not use our website or products for unlawful or unauthorized purposes.

4. Products and Artwork

BornArab offers artwork and related products displayed on our website.

Product availability, sizes, finishes, framing options, prices and specifications may change from time to time.

We make reasonable efforts to display our products accurately. However, the appearance of colors may vary depending on your screen, device settings, lighting conditions and the characteristics of the printed material.

Minor variations in color, texture, positioning, dimensions or finish that are inherent to the production process may occur and do not necessarily constitute a defect.

Please review the product description, dimensions and selected options carefully before placing your order.

5. Production

BornArab artworks may be produced specifically after an order is placed.

Production times may vary depending on the artwork, size, finish, destination, production capacity and other operational factors.

Production time is separate from shipping and delivery time.

6. Orders

When you place an order, you are making an offer to purchase the selected products subject to these Terms.

Receiving an order confirmation does not necessarily mean that your order has been finally accepted.

We reserve the right, where reasonably necessary, to reject or cancel an order, including in cases involving:

suspected fraud or unauthorized transactions;
incorrect pricing or product information;
technical or inventory errors;
inability to produce or deliver the product;
misuse of promotional offers;
orders that violate these Terms or applicable law.

If we cancel an order after payment has been successfully collected, we will provide an appropriate refund for the cancelled portion of the order.

7. Order Information

You are responsible for ensuring that the information provided when placing an order is complete and accurate.

This includes your:

name;
email address;
billing information;
shipping address;
telephone number where required for delivery;
selected artwork;
size;
finish;
quantity.

BornArab is not responsible for delays or delivery problems caused by incorrect or incomplete information provided by the customer, except where applicable law provides otherwise.

8. Prices

Prices are displayed in the currency shown on the website or at checkout.

We reserve the right to change prices at any time. A price change will not normally affect an order that has already been accepted.

Taxes, duties or other charges may apply depending on your location and will be handled as described at checkout and in our Shipping Policy.

If a product is displayed at an obviously incorrect price because of a technical or administrative error, we reserve the right to correct the error and, where legally permitted, cancel the affected order.

9. Payment

Payment must be completed using one of the payment methods available at checkout.

Payments may be processed by Shopify and third-party payment providers.

We do not guarantee that every payment method will be available in every country.

An order may be delayed, rejected or cancelled if payment cannot be authorized or if the transaction is identified as potentially fraudulent.

10. Promotions and Discount Codes

From time to time, BornArab may offer promotional codes, discounts or special offers.

Unless otherwise stated:

promotions cannot be exchanged for cash;
discount codes may be subject to expiration dates or eligibility requirements;
multiple promotions may not be combinable;
promotions may apply only to selected products or markets.

We reserve the right to refuse, cancel or correct the misuse of promotional offers, including fraudulent or unintended use.

11. Order Changes and Cancellations

If you need to change or cancel an order, contact us as soon as possible at contact@bornarab.com.

We will make reasonable efforts to accommodate your request if production has not yet started.

However, because artworks may enter production shortly after an order is placed, we cannot guarantee that an order can be changed or cancelled once production has begun.

Submitting a cancellation or modification request does not mean that the request has been accepted.

Nothing in this section limits any cancellation rights that cannot legally be excluded under applicable consumer law.

12. Shipping and Delivery

BornArab currently serves selected destinations displayed on our website and at checkout.

Delivery estimates are estimates only unless expressly stated otherwise.

Production and delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather, peak periods or disruptions to logistics networks.

Once available, tracking information will normally be sent to the email address associated with your order.

13. Customs, Duties and Taxes

Depending on the destination, orders may be subject to taxes, customs duties, import charges or other governmental fees.

Where these charges are not collected at checkout, they may be payable by the recipient.

The treatment of taxes and duties may vary depending on your location and applicable regulations.

Refusing a shipment solely because customs duties or import charges are due does not automatically entitle the customer to a refund, subject always to applicable consumer law.

14. Returns and Refunds

Returns, refunds, cancellations and exchanges are governed by our Return and Refund Policy.

Because certain BornArab products may be produced specifically for an order, eligibility for a return or cancellation may differ from products held in standard inventory.

Please review our Return and Refund Policy before purchasing.

Nothing in these Terms excludes or limits any consumer rights that cannot legally be excluded or limited.

15. Damaged, Defective or Incorrect Orders

If your artwork arrives damaged, defective or materially different from what you ordered, please contact us as soon as possible.

We may ask you to provide:

your order number;
photographs of the complete artwork;
close-up photographs showing the issue;
photographs of the packaging;
photographs of the shipping label where relevant.

Please keep the artwork and its packaging until your claim has been reviewed.

Do not return or dispose of an affected product unless we ask you to do so.

Once the issue has been verified, we will provide an appropriate solution in accordance with our policies and applicable law.

16. Lost or Delayed Shipments

If a shipment appears to be lost or significantly delayed, contact us with your order and tracking information.

We may investigate the shipment with the relevant fulfillment or delivery provider before determining the appropriate resolution.

Carrier delays do not automatically mean that a shipment has been lost.

17. Intellectual Property

Unless otherwise stated, the BornArab website and its contents are owned by, licensed to or otherwise lawfully used by BornArab.

This includes, where applicable:

artworks;
illustrations;
photographs;
graphics;
designs;
product images;
videos;
written content;
logos;
branding;
website design;
collection concepts;
visual materials.

These materials may be protected by copyright, trademark and other intellectual property laws.

Purchasing an artwork or product does not transfer copyright or other intellectual property rights in the underlying artwork to you.

Your purchase gives you ownership of the physical product purchased, subject to applicable law, but does not grant you the right to reproduce or commercially exploit the artwork.

18. Prohibited Use of Our Artwork

Unless you have received prior written permission from BornArab or the relevant rights holder, you may not:

reproduce our artwork;
scan or digitally copy artwork for redistribution;
sell reproductions;
use artwork on merchandise;
commercially print or manufacture products using our artwork;
modify artwork for commercial distribution;
upload our artwork to print-on-demand services;
use our artwork as part of another commercial product;
claim our artwork as your own.

This applies regardless of whether you purchased a physical BornArab product.

19. Artists and Third-Party Rights

Some artwork available through BornArab may be created by independent artists, collaborators or other rights holders.

The applicable artist or rights holder may retain copyright and other intellectual property rights in their work.

BornArab’s ability to sell a physical artwork does not grant customers permission to reproduce or commercially exploit that artwork.

20. BornArab Brand

The BornArab name, branding, logos, graphics and distinctive brand elements may not be used in a manner that suggests sponsorship, partnership, authorization or affiliation without our prior written permission.

Nothing on our website grants a license to use the BornArab brand except where expressly stated.

21. User Content

If you submit photographs, reviews, messages, feedback or other content to BornArab, you remain responsible for the content you submit.

You confirm that you have the necessary rights to provide that content and that it does not unlawfully infringe the rights of another person.

We will not use customer photographs or other submitted content for public marketing in a manner requiring permission without obtaining the appropriate permission where required.

22. Reviews and Feedback

If you voluntarily submit a review or feedback, we may display or use that review in connection with BornArab, subject to applicable law and any permissions required.

We may moderate or decline to publish content that is fraudulent, abusive, unlawful, irrelevant or otherwise inappropriate.

We will not knowingly present fabricated customer reviews as genuine customer experiences.

23. Third-Party Services and Links

Our website may contain links to or integrations with third-party websites, payment providers, shipping providers, social platforms or other services.

BornArab does not control all third-party services and is not responsible for their independent content, availability, privacy practices or terms.

Your use of third-party services may be governed by their own terms and policies.

We aim to keep the BornArab website available and accurate, but we cannot guarantee uninterrupted or error-free access.
